What this rule requires your agency to do

  • 1The agency shall have written personnel policies covering wage/hours/leave, a preemployment medical exam with follow-up exams no less than every three (3) years for staff serving patients in the home, annual tuberculin screening per 902 KAR 20:205, orientation and on-the-job training, annual employee performance evaluation, and job descriptions for each category (Section 4(1)(a)-(f)).(902 KAR 20:081 Section 4 — Personnel; Supervision and Training)
  • 2The agency shall conduct pre-employment abuse registry checks per KRS 216.937 and KRS 209.032, and pre-employment criminal background checks; it shall not employ an individual in a direct-service position who has been convicted of specified felonies (theft; drug abuse/possession/sale; abuse/neglect/exploitation of a child or adult; a sexual crime) or a misdemeanor related to abuse, neglect, or exploitation of an adult (Section 4(1)(g)-(h)).(902 KAR 20:081 Section 4 — Personnel; Supervision and Training)
  • 3The agency shall ensure each home health aide completes an aide training and competency evaluation program covering the enumerated subjects (self-reliance, nutrition, aging/emotional issues, environment, condition changes, team work, ethics/confidentiality/recordkeeping) (Section 4(5)(a)).(902 KAR 20:081 Section 4 — Personnel; Supervision and Training)
  • 4For patients receiving a skilled service, the RN or qualified practitioner shall make a supervisory visit to the patient's residence at least every two (2) weeks; for patients not receiving a skilled service, the RN shall make a supervisory visit at least every sixty (60) days while the aide is providing care (Section 4(4)(c)-(d)).(902 KAR 20:081 Section 4 — Personnel; Supervision and Training)
  • 5Aides and supplementary personnel shall be trained and supervised by a qualified practitioner within scope; if supervision is less than full-time it shall be planned and assure adequate review of each plan of care and progress (Section 4(3)).(902 KAR 20:081 Section 4 — Personnel; Supervision and Training)
  • 6A home health aide serving a patient exhibiting Alzheimer's/dementia symptoms shall complete at least six (6) hours initial and three (3) hours annual dementia-care training (per KRS 216.9375), completing initial training before providing such care; the agency shall obtain cabinet approval of its curriculum (910 KAR 4:010), issue completion certificates, and maintain documentation (Section 4(5)(b)-(c)).(902 KAR 20:081 Section 4 — Personnel; Supervision and Training)
