What this rule requires your agency to do

  • 1The provider must ensure that any personal support specialist / personal care assistant holds a valid Department-approved certificate of training that includes at least fifty (50) hours of formal classroom instruction, demonstration, return demonstration, and examination.   • 2The provider must ensure each Direct Support Professional has successfully completed the DHHS-adopted Direct Support Professional curriculum, or demonstrated proficiency through DHHS's approved Assessment of Prior Learning, before working independently with members.   • 3The provider must ensure each direct-care worker is at least 18 years old, holds a high school diploma or GED, and has completed the Reportable Events and Behavior Regulations Training. (§ 144-101-II-20.10-6)(§ 144-101-II-20.10-6)
  • 4The provider must ensure that a DSP completing the Maine College of Direct Support curriculum finishes it within 90 days of the date of hire and completes the required core modules before serving members alone. (§ 144-101-II-20.10-6)(§ 144-101-II-20.10-6)
  • 5The provider must conduct required background checks for direct access personnel and their immediate supervisors before they provide services. (§ 144-101-II-20.10-6)(§ 144-101-II-20.10-6)
  • 6The provider must ensure that personnel providing personal care services hold one of the qualifying credentials — current listing as a certified nursing assistant on the Maine Registry, a valid nurse's aide or home health aide training certificate issued within the past three years, a passing score on the Department's approved personal support specialist competency examination, or qualified DSP status. Under Maine's MaineCare Section 20 HCBS rule, providers of home and community-based personal care and support services must ensure each Direct Support Professional / Personal Support Specialist meets defined training, competency, and background-check qualifications before serving members independently. Acceptable qualifications include completing a DHHS-adopted DSP curriculum, passing DHHS's Assessment of Prior Learning, completing the Maine College of Direct Support curriculum within 90 days of hire, or holding a Department-approved personal support specialist/personal care assistant certificate with at least 50 hours of formal classroom instruction.
