Background Checks Program

What this rule requires your agency to do

  • 1Entities must not employ or contract with individuals whose convictions or governmental findings affect their eligibility to serve in caregiving roles (per the offenses-affecting-eligibility list, P-00274).(Background Checks Program)
  • 2Caregiver background checks are required at the time of hire, when there is a change in circumstances, and at least every four years thereafter.(Background Checks Program)
  • 3Entities must conduct background checks for employees and contractors that have regular and direct contact with clients.(Background Checks Program)
  • 4Entities must provide notifications to clients or guardians for certain convictions when the client is receiving services in their private residence (per P-03164).(Background Checks Program)
  • 5DQA background checks for entity operators, non-client residents, and rehabilitation review applicants are required at a minimum every four years and/or when there is a change in status.(Background Checks Program)
  • 6Entity operators, non-client residents, and rehabilitation review applicants must apply for a background check completed by DQA, submitted through the DHS DQA Provider Portal.(Background Checks Program)
  • 7Entities must maintain background check documentation in accordance with the Caregiver Background Check Documentation Requirements (P-03513).(Background Checks Program)
