What this rule requires your agency to do
- 1The provider (mandatory reporter) must make the report as soon as reasonably practicable but not later than 24 hours after the person knows or has reasonable cause to believe that the older person or vulnerable person has been abused, neglected, exploited, isolated or abandoned. - 2The provider must ensure that every person who maintains or is employed by an agency to provide personal care services in the home reports known or reasonably suspected abuse, neglect, exploitation, isolation or abandonment of an older person or vulnerable person. - 3The provider must direct the report to the local office of the Aging and Disability Services Division of the Department of Health and Human Services, a police department or sheriff's office, or the toll-free telephone service designated by the Aging and Disability Services Division. - 4The provider must recognize that a person who knowingly and willfully fails to make a required report is guilty of a misdemeanor. (NRS 200.5093(9))(Nev. Rev. Stat. Applies to: Personal care services provided in the home; agencies and their employees who provide personal care in the home; other listed mandatory reporters
NRS 200.5093 makes designated persons — including every person who maintains or is employed by an agency to provide personal care services in the home — mandatory reporters of abuse, neglect, exploitation, isolation or abandonment of an older person or vulnerable person. Reports must be made as soon as reasonably practicable but not later than 24 hours after the reporter knows or has reasonable cause to believe such conduct occurred, to the local Aging and Disability Services Division office, a police department or sheriff's office, or the toll-free service designated by the Division. Knowing and willful violation is a misdemeanor.
