What this rule requires your agency to do

- 2The provider must ensure all persons providing waiver services, including managers, supervisors, direct care staff, self-direction participant employees, and anyone with unsupervised access to participants, complete and pass a background screening. - 5The provider must ensure staff clear all background screenings before serving participants under 17, and may only allow provisional unsupervised service to adult participants pending clearance when no disqualifying crimes appear on the applications. - 7The provider must not employ in a covered role any individual with convictions, guilty or no-contest pleas, or pending deferred prosecutions for disqualifying offenses against persons (e.g., homicide, sexual assault, assault, human trafficking) or against morals/family (e.g., child endangerment, incest, child abuse involving controlled substances).
