What this rule requires your agency to do
- 1The provider must report Type I incidents (abuse, neglect, death, unexpected hospital admission/ER visit, serious injury, significant medication error, and choking requiring intervention) to OHCQ, the DDA regional office, the resource coordinator, and the family/legal guardian, and to the Maryland Disability Law Center or law enforcement/APS where applicable. - 6The provider must report Type II incidents (law enforcement/fire/EMS involvement, theft of $50 or more, unexpected absence exceeding 4 hours or constituting immediate danger, and unauthorized or injurious restraint) to the DDA regional office, the resource coordinator, and the family/legal guardian. - 7The provider must ensure that all incidents, including those involving life-threatening conditions, are reported and investigated in accordance with the Administration's procedures on reportable incidents. Applies to: Community agencies licensed by DDA and certified support brokers providing DDA-funded home and community-based services to people with developmental disabilities
Maryland DDA-licensed community/HCBS providers must report reportable incidents (Type I: abuse, neglect, death, injury, unplanned hospitalization/ER, medication error, choking; Type II: law-enforcement/EMS involvement, theft, unexpected absence over 4 hours, unauthorized restraint) by immediate initial notification, filing a completed Incident Report within 1 working day and an agency investigation report within 10 working days of discovery, with notice to OHCQ, the DDA regional office, the resource coordinator, and family/guardian.
