26 TAC 558.282 — Client Conduct and Responsibility and Client Rights

What this rule requires your agency to do
- 1Ensure clients are treated with consideration/respect, kept free from abuse/neglect/exploitation by employees, volunteers, or contractors, given confidential treatment of records, and able to voice grievances without discrimination or reprisal (subsec. - 2Adopt and enforce a written policy governing client conduct/responsibility and client rights that includes a grievance mechanism the client can use without fear of reprisal, and protect and promote the rights of all clients (subsec. - 5In advance of furnishing care, or during the initial evaluation visit before treatment, provide the client or legal representative written notice of all client conduct/responsibility and client rights policies (subsec. (e)).(26 TAC 558.282 — Client Conduct and Responsibility and Client Rights)
- 6At admission, give each client a written statement that a complaint may be directed to HHSC Complaint and Incident Intake (P.O. Box 149030, Austin, TX 78714-9030; 1-800-458-9858), and if it states complaints may go to the administrator, include the agency's complaint review/resolution time frame (subsec. - 7Inform the client in advance about the care, plan of care, expected outcomes, barriers, and changes, and obtain signed/marked written informed consent from the client or legal representative for every client (subsec. (f)(1)).(26 TAC 558.282 — Client Conduct and Responsibility and Client Rights)
- 8Comply with Texas Human Resources Code Chapter 102 for any client 60 years of age or older (subsec. (c)).(26 TAC 558.282 — Client Conduct and Responsibility and Client Rights)

Requires a HCSSA to adopt and enforce a written client rights and conduct policy with a no-reprisal grievance mechanism, provide clients written notice of rights and of how to file complaints with HHSC, and protect enumerated client rights including informed consent, participation in care planning, refusal of care, confidentiality, freedom from abuse/neglect/exploitation, and voicing grievances without reprisal.
