What this rule requires your agency to do
- 1The agency must provide verbal notification (or email/text if preferred) to the parent of a minor or the legal guardian as soon as possible, but no later than twenty-four (24) hours following the agency's notification of an abuse, neglect, or misuse allegation. - 2The agency must immediately report any allegation or suspicion of abuse, neglect, or misuse of funds/property to the applicable division in accordance with the procedures in 9 CSR 10-5.200. (9 CSR 10-5.206(2)(B))(9 CSR 10-5.206 - Report of Events)
- 3The agency must report DBH-served events using the EMT Community Event Report form (MO 650-9475) to designated DBH staff, and for after-hours events submit a written report by the next business day. (9 CSR 10-5.206(2)(A)(2) and (2)(C)(1))(9 CSR 10-5.206 - Report of Events)
- 4The agency must report DD-served events through the CIMOR-EMT system per established protocols, and for after-hours events provide a verbal report via the on-call protocol followed by CIMOR-EMT entry by the next business day. - 5The agency must ensure that events are reported in accordance with the protocol established by the Division of Developmental Disabilities (DD) or Division of Behavioral Health (DBH), as applicable to the individual being served, through the designated agency designee(s). Missouri DMH rule 9 CSR 10-5.206 requires community HCBS provider agencies serving individuals with developmental disabilities or behavioral health needs to report critical events (including abuse, neglect, and misuse of funds/property) to the applicable DMH division, following prescribed timeframes and reporting systems, and to notify guardians/parents within 24 hours.
