907 KAR 12:010. Supports for Community Living (SCL) waiver service and coverage policies

What this rule requires your agency to do
- 1A provider shall require a background check and drug testing for each employee paid with department-administered funds who provides support to, or manages funds/services on behalf of, a participant using SCL services, and for volunteers who may interact with a participant.(907 KAR 12:010. - 2For each potential employee or volunteer, the provider shall obtain the results of a criminal record check from the Kentucky AOC (and out-of-state equivalent), a nurse aide abuse registry check (906 KAR 1:100), a caregiver misconduct registry check (922 KAR 5:120), and within 30 days of hire/volunteerism a central registry check (922 KAR 1:470); or may use Kentucky's national background check program (906 KAR 1:190).(907 KAR 12:010. - 3The provider shall for each potential employee obtain negative results of drug testing for illicit or prohibited drugs, and shall ensure a placed volunteer does not have unsupervised interaction with a participant.(907 KAR 12:010. - 4On an annual basis the provider shall randomly select and perform criminal history, nurse aide abuse registry, central registry, and caregiver misconduct registry checks of at least twenty-five (25) percent of employees, and conduct drug testing of at least five (5) percent of employees.(907 KAR 12:010. - 5The provider shall not use an employee or volunteer to provide 1915(c) waiver services if the person has a KRS 17.165(1)-(3) offense conviction, an uncompleted felony conviction/diversion, a drug-related conviction within the past five years, a positive drug test, an abuse/neglect/exploitation conviction or registry finding, or is listed on the nurse aide abuse registry; and shall not permit an employee to transport a participant if the employee has a DUI conviction/plea/diversion in the past year.(907 KAR 12:010. - 6The provider shall maintain adequate staffing and supervision to implement services being billed and establish written guidelines ensuring participant health, safety, and welfare including a basic infection control plan (universal precautions, hand washing).(907 KAR 12:010. - 7The provider shall ensure all case managers or employees (unless a licensed professional) complete Kentucky College of Direct Support Phase II modules no later than six (6) months from employment, and each case manager completes DBHDID-approved case management training after three (3) but within nine (9) months from hire.(907 KAR 12:010. - 8The provider shall ensure each case manager or employee, prior to independent functioning and no later than six (6) months from the date of employment, successfully completes training including first aid and CPR certification, crisis prevention and intervention training (restraint-free, DBHDID-approved), Kentucky College of Direct Support Phase I modules, individualized instruction on the participant's person-centered service plan, and verification of competency.(907 KAR 12:010.
