What this rule requires your agency to do

  • 1The provider shall establish policies and procedures for reporting abuse, neglect, extortion, or exploitation of clients pursuant to R.S. 15:1504-1505, R.S. 40:2009.20, and subsequently enacted laws, and shall ensure staff comply (§I-5053.E).(LAC 48:I.5053 — Provider Responsibilities: Staffing and Abuse/Neglect Reporting (HCBS Providers Licensing Standards))

Requires Home and Community-Based Services (HCBS) providers — including personal care attendant agencies — to maintain qualified staff sufficient to meet each client's ISP needs and emergencies, keep clients informed of the published phone number and return calls within one business day, and establish and enforce policies for reporting abuse, neglect, extortion, or exploitation of clients. Fills the framework gaps for staffing/supervision and incident/abuse reporting for personal care.
