IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications

What this rule requires your agency to do

  • 1Where care is provided in the participant's own home and the participant has a non-physical-only developmental disability requiring more than physical assistance, all who provide care must have completed a Department-approved developmental disabilities training course or have experience providing direct services to people with developmental disabilities (305.02).(IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications)
  • 2All personal assistants must have at least one of the following qualifications: RN; LPN; or Personal Assistant who meets the standards of Section 39-5603, Idaho Code, receives training to ensure quality of services, and is at least 18 years of age (305.01).(IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications)
  • 3When care for a child is delivered in the provider's home, the provider must be licensed or certified for the appropriate level of child foster care or day care, licensed for care of individuals under age 18 under Section 39-1213, Idaho Code (305.04).(IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications)
  • 4Except in extraordinary circumstances defined by the Department, a Medicaid-paid PCS provider cannot be the spouse of any participant or the parent of a participant who is a minor child (305.03).(IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications)
  • 5Providers qualified as QIDPs are exempted from the Department-approved developmental disabilities training course (305.02.c).(IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications)
  • 6Under regional temporary approval, the provider must enroll in the next available training course with graduation no later than six months from the request, and the supervising QIDP must make monthly visits until the provider graduates (305.02.d).(IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications)
  • 7All PCS providers, including service coordinators, RN supervisors, QIDP supervisors, and personal assistants, must obtain a background check as required by Section 39-5604, Idaho Code, conducted under IDAPA 16.05.06, "Criminal History and Background Checks" (305.06).(IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications)
  • 8When care for an adult is provided in a home owned or leased by the provider, the provider must be certified as a CFH under IDAPA 16.03.19, "Certified Family Homes" (305.05).(IDAPA 16.03.10.305 - Personal Care Services: Provider Qualifications)
