What this rule requires your agency to do

  • 1The provider must submit the report through the Reportable Event Database, or by fax where database access is unavailable within the one-business-day period. (14-197 C.M.R. ch. 12, § 2)(14-197 C.M.R. ch. 12, § 2)
  • 2The provider must report each Reportable Event as soon as possible and within one (1) business day of the Reportable Event. (14-197 C.M.R. ch. 12, § 2)(14-197 C.M.R. ch. 12, § 2)
  • 3The provider (and its employers, supervisors, managers, and associates) must not impede or inhibit a Required Reporter's reporting of a Reportable Event, must not require permission to be granted before reporting, and must not subject a person making a report to any sanction.   • 4The provider must report all covered Reportable Events (Section 2(2)(A)(1)-(16), e.g., death, suicide attempts/threats, emergency department visits, hospital admissions, medication errors affecting health/safety, serious injuries, missing persons, law enforcement involvement, transportation accidents, physical assaults, emergency restraints, and rights violations).   • 5The provider's Required Reporter must report a Reportable Event through the Reportable Event Database whenever he or she becomes aware of an incident involving an Individual Receiving Services that meets the defined criteria. Applies to: Home and community-based services providers and their staff (Required Reporters) serving individuals receiving OADS/MaineCare community services

Maine's Reportable Events System (14-197 C.M.R. ch. 12) requires designated Required Reporters at HCBS/community services providers to report critical incidents involving individuals receiving services (death, serious injury, medication errors, missing persons, assaults, emergency restraints, rights violations, etc.) through the Reportable Event Database as soon as possible and within one business day, and prohibits anyone from impeding a reporter.
