Caregiver Background Check Documentation Requirements (P-03513)

What this rule requires your agency to do
- 1On the caregiver's first day of employment/contract (Part A), the entity must have either a completed E-Background Information Disclosure (eBID), F-82064, with no barring offenses disclosed, OR an Agency Letter of Rehabilitation Approval from DHS specifying rehabilitation approval for all barring offenses and approval to work in the entity setting.(Caregiver Background Check Documentation Requirements (P-03513))
- 2No later than 60 days after the first day of employment/contract (provided the caregiver is supervised per DHS 12.11; otherwise on the first day), the entity must meet Part A requirements AND, for individuals age 18 or older, obtain either (a) a "caregiver" background check from the WI DOJ WORCS system (a "no record found" response or criminal record transcript) plus a Governmental Findings Report, or (b) a letter from a third-party background check vendor listing names/SSNs, convictions, substantiated misconduct/licensure findings, and other DHS/DSPS credential limitations.(Caregiver Background Check Documentation Requirements (P-03513))
- 3For a pending charge for a serious crime, the entity must document every reasonable effort to contact the clerk of courts to obtain the criminal complaint and determine the final disposition of the charge.(Caregiver Background Check Documentation Requirements (P-03513))
- 4For a caregiver discharged from a branch of the U.S. armed forces in the past 3 years, the entity must document a good-faith effort to obtain documentation of the reason for discharge (e.g., DD214 form); for current or previous out-of-state residence in the past 3 years, document a good-faith effort to obtain an equivalent background check from that jurisdiction.(Caregiver Background Check Documentation Requirements (P-03513))
- 5Where the entity is a personal care agency and the individual has a conviction specified in Table DHS 12.115, the entity must document the notifications required under s. 50.065(2m), Wis. Stats.(Caregiver Background Check Documentation Requirements (P-03513))
- 6No later than 4 years from the date of the most-recent Background Information Disclosure (Part C), the entity must obtain either a newly completed BID or, if the entity has enacted a disclosure policy under s. 50.065(6)(am), all applicable Part B documentation.(Caregiver Background Check Documentation Requirements (P-03513))

- 8For a non-barring enumerated conviction, the entity must document every reasonable effort to contact the clerk of courts to obtain the criminal complaint and judgment of conviction.(Caregiver Background Check Documentation Requirements (P-03513))
