What this rule requires your agency to do

  • 1When there is reasonable cause to suspect that a vulnerable adult died as a result of abuse, neglect, or exploitation, the person must immediately report the suspicion to the appropriate medical examiner, criminal justice agency, and the department, regardless of any existing death certificate.   • 2The provider/caregiver must immediately report to the central abuse hotline any knowledge or reasonable cause to suspect that a vulnerable adult has been or is being abused, neglected, or exploited.   • 3The reporter must include in the report, to the extent of available information, the vulnerable adult's identity and location, the alleged perpetrator's and caregiver's information, a description of injuries, and any actions taken.   • 4The mandatory reporting duty must be met by covered persons including health and mental health professionals, nursing home, assisted living facility, adult day care center staff, and social workers who provide care to vulnerable adults. Applies to: Home care, personal care, and HCBS caregivers and staff serving vulnerable adults

Florida law imposes a mandatory duty on any person — expressly including health professionals, nursing home/ALF/adult day care staff, social workers, and other caregivers — who knows or has reasonable cause to suspect that a vulnerable adult is being abused, neglected, or exploited to immediately report to the DCF central abuse hotline. The statute prescribes the information a report should contain and requires immediate reporting of suspected abuse-related deaths to the medical examiner, criminal justice agency, and the department.
