What this rule requires your agency to do

  • 1Any planned deviation of the provider's days and hours of operation shall be reported to the Health Standards Section within five business days; any unplanned deviation within two business days. (§5031.B.2.a–b)(§5031.B.2.a–b)
  • 2The governing body shall be comprised of three or more persons and shall hold formal meetings at least twice a year, with written minutes and by-laws. (§5027.A.2–3)(§5027.A.2–3)
  • 3The written discharge summary for a voluntary transfer/discharge shall be completed within five working days of the client's notice. (§5035.D)(§5035.D)
  • 4No branch office or satellite location may be opened without prior written approval from HSS, and the parent agency shall have maintained full licensure for the previous 12-month period. (§5032.A.1)(§5032.A.1)
  • 5The governing body shall ensure statewide criminal background checks on all unlicensed persons providing direct care and services to clients in accordance with R.S. 40:1203.2 upon hire, and shall not hire unlicensed persons with a conviction that bars employment under R.S. 40:1203.3.   • 6The business location shall have a published telephone number available and accessible 24 hours a day, 7 days a week, including holidays, and a working, monitored e-mail address provided to the department (changes within five working days). (§5031.D.3, D.5)(§5031.D.3, D.5)
  • 7For involuntary transfer or discharge, the provider shall provide written notice — via certified mail, return receipt requested, in a language and manner the client understands — to the client, family member, authorized representative, and support coordinator at least 30 calendar days prior, containing the nine required elements including appeal rights.   • 8The provider shall have written policies and procedures approved by the owner or governing body addressing, at minimum, the 14 enumerated areas including confidentiality, personnel, client rights, grievance procedures, emergency preparedness, abuse/neglect/exploitation/extortion, incidents and accidents, documentation, and admission/discharge procedures.
