What this rule requires your agency to do
- 1The agency must have an organized governing body legally responsible for the agency, fully disclose ownership to the Department, ensure staff are currently licensed/registered under Oklahoma law, and conduct periodic administrative and professional evaluations (a).(OAC 310:662-3-4 — Organization)
- 2The governing body must appoint a qualified, Department-certified administrator who directs functions, employs qualified personnel, ensures in-service/continuing education and evaluations, and ensures accuracy of public information; proof of current administrator certification must be posted conspicuously at each licensed agency (c).(OAC 310:662-3-4 — Organization)
- 3The agency must maintain sufficient financial resources and an annual operating budget ensuring it can meet operating costs and Chapter standards at all times (b).(OAC 310:662-3-4 — Organization)
- 4For any contracted home care services, the agency must have a written agreement defining services, coordination/evaluation/supervision, plan-of-care development, scheduling, and clinical-note submission, and must obtain and maintain verification of the contractor's personnel licensure/certification (g).(OAC 310:662-3-4 — Organization)
- 5The agency must maintain personnel records including qualifications, employment history, orientation/in-service records, verification of health screening, performance evaluations, disciplinary actions, and verification of current licensure/certification (f).(OAC 310:662-3-4 — Organization)
- 6The agency must implement written personnel policies covering employment procedures, orientation and in-service, job descriptions/qualifications, periodic performance evaluations, disciplinary action procedures, and health screening (including TB testing per CDC/TB Controllers Association 2019 guidelines) (e)(1)-(6).(OAC 310:662-3-4 — Organization)
- 7The agency must operate an annual influenza vaccination program: offer onsite vaccination at no charge or accept documented evidence, document vaccination or a signed declination for each employee/worker, educate workers, and conduct an annual program evaluation (e)(7).(OAC 310:662-3-4 — Organization)
- 8An agency providing personal care must employ or contract with a supervising physician or RN available to advise client care staff whenever personal care is provided (may be on-call), with a written designated alternate for the supervising RN's absence (d).(OAC 310:662-3-4 — Organization)
