What this rule requires your agency to do

  • 1The provider shall provide evidence of competence in the enumerated generally accepted procedures (infection control/handwashing, body-fluid handling, bathing, hair/oral care, incontinence care, feeding, meal preparation, medication self-administration assistance, housekeeping, laundry, dressing, toileting, skin/eye/nail care, turning/positioning, transfers, ambulation, bed-making) or meet developmental disability competency standards under chapters 75-04-01 and 75-04-07 (§ 75-03-21-08(2)).(N.D.   • 2The provider shall be twenty-one years of age or older, live continuously in the facility, possess the physical health necessary to provide care, be literate and able to understand instructions and communicate in English, be free of communicable diseases, and be in good physical health, emotionally and functionally stable, and not abusing drugs or alcohol (§ 75-03-21-08(1)(a)-(f)).(N.D.
