What this rule requires your agency to do

- 2The provider (and indirect owners with 5% or more ownership in a high-risk provider) must submit a set of fingerprints within thirty days upon request from the department for a fingerprint-based criminal background check. Applies to: Applies to all enrolled or newly enrolling North Dakota Medicaid providers and their 5%+ indirect owners, including personal care / HCBS Qualified Service Providers designated high-risk; part of Chapter 75-02-05 Provider Integrity.
Chapter 75-02-05 (Provider Integrity) of the North Dakota Administrative Code requires the Department of Health and Human Services to conduct fingerprint-based criminal background checks on enrolled and newly enrolling Medicaid providers (including high-risk personal-care / HCBS Qualified Service Providers) and their 5%-or-greater indirect owners, with the Medical Services Division reviewing results to determine enrollment eligibility.
