Rule 173-39-03 | ODA provider certification: applying for certification

What this rule requires your agency to do

  • 1Upon approval, the provider shall enter into an agreement with ODA's designee specifying the term, the region certified, and the accepted rate of payment per unit subject to ODM rate limits.(Rule 173-39-03 | ODA provider certification: applying for certification)
  • 2A provider whose application is denied is ineligible to reapply for certification for one year after the mailing date of ODA's final adjudication order.(Rule 173-39-03 | ODA provider certification: applying for certification)
  • 3For a pre-certification review, the provider must allow ODA's designee to visit the provider's business site (or complete a desk review) to determine compliance with rule 173-39-02 and any additional service-specific requirements.(Rule 173-39-03 | ODA provider certification: applying for certification)
  • 4A person applying for certification shall complete an application in the provider management system, including electronic submission of all supporting records; an incomplete application expires if not completed within ninety days.(Rule 173-39-03 | ODA provider certification: applying for certification)
  • 5Providers of ADS or assisted living service are subject to the HCBS settings requirements in 42 C.F.R. 441.301 and rule 5160-44-01, and to heightened scrutiny under rule 173-39-03.1 if the setting is presumed to have institutional qualities.(Rule 173-39-03 | ODA provider certification: applying for certification)
  • 6A provider moving to Ohio from another state must meet the qualifications in R.C. 4796.03/4796.04/4796.05, not be disqualified under Chapter 173-9 or R.C. 173.38/173.381, not be disqualified under rule 5160-1-17.8, and meet the insurance requirement in rule 173-39-02(A)(5).(Rule 173-39-03 | ODA provider certification: applying for certification)
