What this rule requires your agency to do
- 1The department shall perform a Michelle P. waiver service level of care determination for each participant at least once every twelve (12) months or more often if necessary.(907 KAR 1:835. Michelle P. waiver services and reimbursement)
- 2A Michelle P. waiver provider must comply with 907 KAR 1:671, 1:672, 1:673, HIPAA (42 U.S.C. 1320d-2; 45 C.F.R. Parts 160, 162, 164), and the Supports for Community Living provider participation requirements in 907 KAR 12:010, Section 3.(907 KAR 1:835. Michelle P. waiver services and reimbursement)
- 3A parent, parents combined, or a spouse shall not provide more than forty (40) hours of services in a calendar week (Sunday through Saturday) regardless of the number of children who receive waiver services.(907 KAR 1:835. Michelle P. waiver services and reimbursement)
- 4A PDS provider must submit to a criminal background check from the Kentucky AOC (and out-of-state equivalent), and to checks of the Nurse Aide Abuse Registry (906 KAR 1:100), Vulnerable Adult Maltreatment Registry (922 KAR 5:120), and Central Registry (922 KAR 1:470), and must not be found on any of them.(907 KAR 1:835. - 5Before employing or using a potential employee or volunteer, the provider must obtain the results of a Vulnerable Adult Maltreatment Registry check (922 KAR 5:120) or equivalent out-of-state check if the individual resided/worked outside Kentucky in the prior year.(907 KAR 1:835. - 6To provide Michelle P. waiver services (excluding PDS), a provider must be licensed as an adult day health care provider (902 KAR 20:066), group home (902 KAR 20:078), home health agency (902 KAR 20:081), or community mental health center (902 KAR 20:091), or be certified by the department under 907 KAR 12:010.(907 KAR 1:835. - 7A PDS provider must not have pled guilty to or been convicted of a sex crime or violent crime, must complete training on reporting abuse/neglect/exploitation (KRS 209.030 or 620.030) and on the needs of the participant, must be approved by the department, and must maintain and submit timesheets documenting hours worked.(907 KAR 1:835. - 8A Michelle P. waiver provider must maintain a clinical record in the MWMA for each participant including medical/nursing/social history, a comprehensive assessment (MAP 351) signed by the assessment team and department, a person-centered service plan, and a signed MAP-350 certification form at application, reapplication, and each recertification.(907 KAR 1:835.
