- 2The provider must not restrict the required home and community-based qualities for a participant unless the restriction is supported by a documented, specific assessed need and risk-mitigation strategy developed through the person-centered planning process. - 3The provider must ensure the participant (or the participant's representative) selects the setting from among options, including non-disability-specific settings, based on the participant's needs and preferences. Idaho's HCBS "Required Home and Community-Based Qualities" rule requires that Medicaid home- and community-based settings (including personal care and home care settings) protect participant rights — privacy, dignity, respect, freedom from coercion and unauthorized restraint, community integration, autonomy, and choice — consistent with the federal HCBS settings rule.
