What this rule requires your agency to do

  • 1A QSP applicant must have basic ability to read, write, and verbally communicate; must not have been found/pled guilty or no contest to enumerated disqualifying offenses (NDCC ch. 12.1-16 homicide, 12.1-18 kidnapping, sexual/assault/exploitation offenses, etc.) subject to rehabilitation provisions; must maintain confidentiality; be physically capable; and be at least eighteen years of age (§ 75-03-23-07(2)(a)-(g)).(N.D.   • 2Providers of adult day care, adult foster care, community support, extended/family/personal care, nurse assessment, residential/respite/residential habilitation, supervision, and transitional living care shall provide evidence of competency in enumerated procedures (infection control, body-fluid handling, bathing, feeding, medication self-administration assistance, transfers, toileting, skin care, etc.) (§ 75-03-23-07(6)).(N.D.   • 3The department may not approve/deny/renew an application for a QSP charged with a direct-bearing offense (or where the alleged victim was under the applicant's care) until final disposition of the criminal case (§ 75-03-23-07(4)(b)).(N.D.   • 4An applicant for QSP status for listed services shall secure written verification of competency from a physician, chiropractor, RN, LPN, OT, PT, or comparable professional, unless holding a listed license/certification in good standing (§ 75-03-23-07(7)).(N.D.   • 5QSPs shall revalidate enrollment and provide evidence of competency at least every sixty months for an agency or every thirty months for an individual (per Medicaid state plan/waiver timelines), using department forms and documentation (§ 75-03-23-07(2)(e)).(N.D.   • 6Agency providers who employ nonfamily members shall have a department-approved quality improvement program to identify, address, and mitigate harm; agencies accepting 24-hour support authorizations shall give thirty-day written notice before involuntary discharge unless otherwise approved (§ 75-03-23-07(13)-(14)).(N.D.   • 7An individual or agency seeking QSP designation shall complete and submit the applicable department forms and meet all licensure, certification, or competency requirements under state/federal law and departmental standards; application is not complete until all required information and provider verifications are submitted (§ 75-03-23-07(1)).(N.D.
