IDAPA 16.03.07.009 — Criminal History and Background Check Requirements

What this rule requires your agency to do

  • 1The HHA must comply with IDAPA 16.05.06, "Criminal History and Background Checks." (Subsection 01)(IDAPA 16.03.07.009 — Criminal History and Background Check Requirements)

  • 4Owners, administrators, employees, and contractors hired or contracted after October 1, 2007 who have direct patient access must complete and receive Department criminal history and background check clearance.   • 5The agency/individual must have the individual's fingerprints submitted to the Department within twenty-one (21) days of completion of the notarized application. (Subsection 03)(IDAPA 16.03.07.009 — Criminal History and Background Check Requirements)

Requires every Idaho home health agency to comply with the Department's criminal history and background check rule (IDAPA 16.05.06) and mandates that owners, administrators, employees, and contractors with direct patient access complete and clear a Department background check. Direct-access hires must apply before patient access, submit fingerprints within 21 days, and may work only under supervision until fingerprinted.
