What this rule requires your agency to do
- 1For suspected financial exploitation, the reporter must report to state or federal law enforcement, the county prosecuting attorney, the Adult Protective Services Division, or the Medicaid Fraud Division. (W. Va. Code §9-6-9)(W. Va. Code §9-6-9)
- 2The provider must make the report pursuant to the procedures of §9-6-11 of the code (i.e., to the appropriate receiving authority such as Adult Protective Services). (W. Va. Code §9-6-9(a))(W. Va. - 3The mandatory reporter must make the report immediately upon forming reasonable cause to believe the abuse, neglect, financial exploitation, or emergency situation exists. (W. Va. - 4The caregiver/provider (including social service workers and any employee of a nursing home or other residential facility) must report when they have reasonable cause to believe a vulnerable adult or facility resident is or has been neglected, abused, financially exploited, or placed in an emergency situation.
