907 KAR 7:010. Home and community based waiver services version 2

What this rule requires your agency to do
- 1The provider must not allow a staff person to provide HCB services if the individual has a sex/violent crime conviction, is a violent offender, has a prior felony conviction, a drug-related conviction within the past 5 years, a positive drug test, an abuse/neglect/exploitation conviction or registry finding, or a Medicaid/Medicare fraud conviction.(907 KAR 7:010. - 2A PDS provider must be at least 18, selected by the participant, comply with the Section 2(3)(j) background checks and Section 2(3)(k) exclusions, complete abuse-reporting and participant-needs training before employment and DAIL attendant care training annually, obtain first aid (within 6 months) and CPR certification, and maintain timesheets signed by both the participant/representative and the provider.(907 KAR 7:010. - 3Before independently providing a direct service, each staff person must be trained on abuse/neglect/fraud/exploitation and its reporting, person-centered planning, documentation requirements, and HCB service definitions; must receive DAIL attendant care certification training initially and annually; and must obtain CPR and first aid certification within six (6) months of employment and maintain it.(907 KAR 7:010. - 4An HCB waiver provider (excluding PDS) must be approved/licensed/certified as an adult day health care center, home health agency, center for independent living, public health department, home delivered meal provider, or area agency on aging and independent living, and meet the Section 5 service requirements.(907 KAR 7:010. - 5An individual transporting a participant must have a valid driver's license and current liability insurance on the vehicle used.(907 KAR 7:010. Home and community based waiver services version 2)
- 6Each staff person must complete a TB risk assessment by a licensed medical professional within the past 12 months and annually, and (prior to employment) pass a drug test with no indication of prohibited or illicit drug use.(907 KAR 7:010. Home and community based waiver services version 2)
- 7An attendant care provider must maintain a sign-in and sign-out log documenting service date, duration, provider arrival and departure time, a description of the service, and the name, title, and signature of the staff who provided the service.(907 KAR 7:010. - 8Prior to hiring, the provider must obtain a criminal record check from the Kentucky AOC (and equivalent out-of-state agency), a Nurse Aide Abuse Registry check (906 KAR 1:100), and a Caregiver Misconduct Registry check (922 KAR 5:120); and within 30 days of hire obtain a Central Registry check (922 KAR 1:470).(907 KAR 7:010.
