  • 3The provider must ensure the authorizing registered professional nurse holds a current, active, and unencumbered RN license and has practiced in a position requiring knowledge of medications for the immediate two years before overseeing AMAP staff. (W. Va. C.S.R. § 64-60-4)(W. Va. C.S.R. § 64-60-4)

  • 5The provider must ensure an AMAP candidate who fails the first competency test waits seven calendar days before a second attempt, and, after failing three attempts, waits six months to gain more training and experience before restarting competency testing. (W. Va. C.S.R. § 64-60-4)(W. Va. C.S.R. § 64-60-4)
  • 6The provider must ensure AMAP staff are trained by OHFLAC-approved registered professional nurses and work under the supervision of the registered professional nurse. (W. Va. C.S.R. § 64-60)(W. Va. C.S.R. § 64-60)

West Virginia's AMAP legislative rule (Title 64, Series 60) authorizes trained unlicensed personnel to administer medications under RN supervision across five settings, including private residences receiving health care services under RN supervision. Section 64-60-4 sets requirements for the authorizing RN's licensure and experience, RN training, delegation decision-making and resident stability determination, AMAP competency testing sequencing, and liability insurance for non-nursing-home facilities.
