What this rule requires your agency to do
- 1The provider must not employ any applicant with direct access who has been convicted of specified disqualifying crimes, including capital, first- and second-degree murder, rape, and sexual offenses against children. - 2The provider (home health agency operator) must not knowingly employ any person with direct access to consumers who has adverse findings on any applicable state or national registry. - 3The applicant must submit fingerprints within the required timeframe after authorization, and the provider may employ the applicant provisionally for up to 60 calendar days pending results, with supervision by a fully trained employee. - 4The provider must conduct a state and national criminal history record check, including fingerprint submission, on each applicant for a position involving direct access to consumers.
