What this rule requires your agency to do
- 1Providers and FIs of Medicaid-funded PCS must select and put into production use an EVV system meeting the 21st Century Cures Act by January 1, 2021 (HHCS by January 1, 2023) and submit EVV data to the NYS EVV Data Aggregator.(Electronic Visit Verification (EVV) Program Guidelines and Requirements)
- 2Providers and FIs must submit an EVV Attestation to the EVV Program on an annual basis through the eMedNY portal; failure to submit by the required deadline results in referral to OMIG.(Electronic Visit Verification (EVV) Program Guidelines and Requirements)
- 3Providers and FIs are responsible for compiling, maintaining, and validating records justifying the EVV-exempt live-in caregiver status of each such caregiver (shared permanent residence), keeping address verification current at the time services were provided.(Electronic Visit Verification (EVV) Program Guidelines and Requirements)
- 4By October 1, 2021, providers and FIs must provide EVV training to caregivers, staff, and system users before they submit EVV data, provide annual refresher training, and maintain documentation of all trainings.(Electronic Visit Verification (EVV) Program Guidelines and Requirements)
- 5All providers and FIs must retain EVV data for at least seven years from the last date of service (or longer as required by law or MCO contract); records must be retained until any audit initiated within the retention period is completed.(Electronic Visit Verification (EVV) Program Guidelines and Requirements)
