What this rule requires your agency to do

  • 1The agency/provider must not knowingly hire any individual in a position with duties involving direct care if that person has been convicted of committing or attempting to commit one or more of the enumerated disqualifying offenses, unless a waiver is granted.   • 3The agency/provider must, upon making a conditional offer of employment, inquire of the Nurse Aide/Health Care Worker Registry as to the status of the applicant's UCIA criminal history record check. Applies to: Home care / home services agencies and other health care employers hiring direct care workers, nurse aides, and personal care assistants

Under Illinois' Health Care Worker Background Check Act (225 ILCS 46) and its implementing rule (77 Ill. Adm. Code 270.2250), health care employers — including home health and home services agencies employing direct care workers and personal care assistants — must run fingerprint-based UCIA criminal history checks through the Illinois State Police, verify status via the Health Care Worker/Nurse Aide Registry, and may not hire applicants with disqualifying convictions absent a waiver.
