What this rule requires your agency to do
- 1HRS §§321-15.2, 346-97 and 846-2.7 require DOH and DHS to conduct background checks to ensure the reputable and responsible character of prospective applicants, operators, direct patient access employees, and adult volunteers of licensed/certified healthcare facilities, and of home and community-based services (HCBS) providers under the Medicaid 1915(c) Waiver program.(Med-QUEST Criminal History Record & Background Check Program for Home and Community-Based Services (HCBS) Providers (HRS §§321-15.2, 346-97, 846-2.7))
- 2Providers/employers must create an account for these services at www.fieldprinthawaii.com, obtain a Fieldprint code, and give it to applicants/employees to register for fingerprinting collection.(Med-QUEST Criminal History Record & Background Check Program for Home and Community-Based Services (HCBS) Providers (HRS §§321-15.2, 346-97, 846-2.7))
- 3Providers shall assure that all of their employees have a criminal history record check processed according to the specified frequencies: FBI/State fingerprint check (AFIS) within 30 days and within 12 months of new employment; State name check (eCrim) within 30 days, within 12 months, and thereafter; APS screen within 30 days, within 12 months, and bi-annual thereafter; CAN screen within 30 days, within 12 months, and bi-annual thereafter.(Med-QUEST Criminal History Record & Background Check Program for Home and Community-Based Services (HCBS) Providers (HRS §§321-15.2, 346-97, 846-2.7))
- 4A combination of criminal history record, APS and CAN Protective Services Central Registry checks are used to determine employment suitability as defined in §346-97, HRS.(Med-QUEST Criminal History Record & Background Check Program for Home and Community-Based Services (HCBS) Providers (HRS §§321-15.2, 346-97, 846-2.7))
