10A NCAC 13J .1102 — Nursing Services and Duties

What this rule requires your agency to do

  • 4If an agency provides nursing services, those services shall be provided by or under RN supervision and in accordance with the NC Nursing Practice Act (G.S. Ch. 90, Art. 9A), and the client's plan of care shall include the seven minimum RN functions listed (Para. (a)).(10A NCAC 13J .1102 — Nursing Services and Duties)

Applies to: Licensed home care agencies that provide nursing services; supervising RNs; LPNs; in-home aides receiving delegated tasks.

Requires that nursing services of a home care agency be provided by or under RN supervision consistent with the NC Nursing Practice Act, defines RN and LPN duties and plan-of-care requirements, and requires 24/7 on-call nursing coverage with retained on-call schedules. RNs delegate tasks to in-home aides within the limits of 21 NCAC 36 .0225(d)(3).
