What this rule requires your agency to do

  • 1The provider must file a written incident report within twenty-four (24) hours or by the end of the next business day and make it available to OQA within five days.   • 2The provider must report injuries of unknown source and any death that may have been caused by abuse or neglect.   • 3The provider organization must make an immediate report to the Department's OQA when there is reasonable cause to believe an assault or battery has occurred.   • 4The reportable incident submission must include, at minimum, the reporter's name/occupation and organization contact details, the victim's name and address, the date, time and place of the incident, details and observations concerning the incident, the individual's statements, and names of witnesses and alleged perpetrators.   • 5The provider organization must make a telephone report to the BHDDH Office of Quality Assurance (OQA) within twenty-four (24) hours after observing or receiving disclosure of abuse, neglect, mistreatment, financial exploitation, or civil rights violations. Applies to: Community-based developmental disability and behavioral healthcare organizations/facilities licensed by BHDDH (HCBS providers)

RI regulation 212-RICR-10-00-1.20 requires BHDDH-licensed community/HCBS provider organizations to report abuse, neglect, mistreatment, financial exploitation, injuries of unknown source, and deaths potentially caused by abuse/neglect to the Department's Office of Quality Assurance, with telephone reports within 24 hours (immediate for assault/battery) and written follow-up reports containing specified incident details.
